Terms – Truckies Toolbox

These terms apply to the truckiestoolbox.com.au website (the “site”) and the Truckies Toolbox apps (the “apps”), operated by Opus Novum PTY LTD, Melbourne, Australia (“we”, “us”, “our”). By using the site or an app, you agree to these terms. An app may also have its own terms, which apply to that app as well; for example, Truckies Rest Log’s terms are at truckiesrestlog.com.au/terms.

1. Tracking aids, not legal advice

Our apps are tracking aids that help you keep your own records. They are not legal, financial, tax or compliance advice, and they don’t replace the records the law requires you to keep. You remain responsible for complying with the laws that apply to you, including the Heavy Vehicle National Law and your employer’s requirements.

2. Truckies Rest Log and your legal records

Truckies Rest Log is a companion to your paper National Work Diary. It is not an NHVR-approved Electronic Work Diary. You must still fill in your National Work Diary (or use an approved electronic system) and keep your legal records as the law requires.

3. Not a government service

Truckies Toolbox is independent. It isn’t affiliated with or endorsed by the National Heavy Vehicle Regulator (NHVR) or any government agency.

4. Use safely

Don’t use your phone in a way that breaks road rules or distracts you while driving. Set things up when you’re safely parked.

5. Licence to use the apps

We grant you a personal, non-exclusive, non-transferable, revocable licence to use our apps on Apple devices you own or control. The apps are also licensed under Apple’s Licensed Application End User Licence Agreement (the Standard EULA). These terms add to the Standard EULA; if they’re inconsistent about an app, the Standard EULA applies to the extent of the inconsistency.

6. Purchases and refunds

In-app purchases are made through Apple’s App Store and are subject to Apple’s terms. Refund requests are handled by Apple under its policies.

7. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that can’t be excluded.

8. Accuracy

We work hard to keep our apps and this site accurate and up to date, but rules change and mistakes can happen. To the extent permitted by law, we don’t warrant that the apps or the site are complete, current or error-free.

9. Liability

To the extent permitted by law, and subject to section 7, we aren’t liable for any indirect or consequential loss, or for any fine, penalty or loss arising from relying on an app instead of your legal records. Where our liability can’t be excluded but can be limited, it is limited (at our option) to supplying the service again or paying the cost of having it supplied again.

10. Intellectual property

The apps, this site, and the Truckies Toolbox names, logos and icons belong to Opus Novum PTY LTD. Please don’t copy or reuse them without our permission.

11. Changes

We may update these terms from time to time. We’ll post the new version here with a new effective date. Continuing to use the site or apps after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
